1. Scope and Applicability
These Terms and Conditions (“Terms”) govern the purchase and use of eSIM products and related services (“Services”) provided through the website simtaly.com (“Website”) operated by DALASON GmbH (“Company”, “we”, “us”, or “our”).
By purchasing or using any Service, you (“Customer”, “you”) agree to be bound by these Terms.
Customers must be at least 18 years old and have the legal capacity to enter into binding contracts.
2. Service Description
Simtaly offers digital eSIM profiles for mobile data connectivity (“eSIMs”).
After purchase, eSIMs are delivered electronically by email, including installation options via QR code, direct link (Apple devices), or manual configuration.
To use the eSIM, you must have:
- an eSIM-compatible and unlocked device, and
- roaming enabled for the eSIM profile.
The eSIM becomes active when it first connects to a supported network included in the purchased plan.
3. Tariff Types and Data Usage
Simtaly offers:
- Unlimited data plans with a daily high-speed allowance. After this allowance, speed is reduced until renewal (every 24 hours, based on initial activation time). Customers may purchase Day Boost Packages to restore full-speed data for the remainder of the current 24-hour period.
- Prepaid data packages, which include a fixed data volume available at maximum speed until consumed.
Plans are valid for the duration specified at purchase.
It is not a defect if specific local networks are unavailable, provided at least one included network in the destination country functions.
4. Ordering Process and Contract Formation
By completing the purchase process on simtaly.com, you submit a binding offer to purchase an eSIM.
The contract is concluded once we confirm your order electronically (email confirmation).
To complete the purchase, you must provide:
- your email address (for eSIM delivery),
- your mobile number, and
- your current location, to calculate the applicable Value Added Tax (VAT) correctly.
5. Payment and Pricing
Payment is processed securely via Stripe.
All prices are shown inclusive of VAT, which is calculated based on your declared location.
No additional or hidden fees apply beyond the purchase price of the eSIM and any add-on packages.
6. Delivery
eSIMs are delivered digitally via email immediately after payment confirmation.
The customer is responsible for ensuring that their email settings permit receipt of automated messages and QR codes.
7. Refunds and Cancellations
You may request a refund within six (6) months of purchase only if the eSIM has not been activated.
Once activated (i.e., when it first connects to a supported network), the product is considered used, and no refund is available.
Refunds will be processed using the same payment method used for purchase.

9. Liability
The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind.
To the fullest extent permitted by law, DALASON GmbH disclaims all liability for:
- any interruption, unavailability, or malfunction of the Service,
- compatibility with particular devices or software,
- network performance or coverage limitations, and
- indirect, incidental, or consequential damages.
We do not guarantee uninterrupted or error-free operation, nor that all networks or speeds will be available at all times.
Some jurisdictions do not allow such exclusions, in which case liability is limited to the minimum extent required by law.
10. Intellectual Property
All trademarks, logos, and brand names appearing on this Website are the property of their respective owners.
Use of these marks does not imply any affiliation or endorsement unless expressly stated.
11. Links to Third-Party Websites
Our Service may include links to external websites or services operated by third parties.
We have no control over and assume no responsibility for their content, policies, or practices.
Use of third-party services is at your own risk.

12. Legal Jurisdiction and Applicable Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions.
Where legally possible under EU regulations, Cologne (Germany) shall be the place of jurisdiction.
13. Dispute Resolution
If you have a complaint or dispute regarding the Service, you agree to first attempt to resolve it informally by contacting our support team.
If unresolved, you may access EU online dispute resolution platforms or applicable consumer arbitration options under EU law.
14. Compliance with United States Laws
You represent and warrant that:
- (i) you are not located in a country subject to a U.S. government embargo or designated as supporting terrorism, and
- (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
15. Modifications to Terms
We reserve the right to modify these Terms at any time at our sole discretion.
If changes are material, we will make reasonable efforts to provide at least 30 days’ notice before the new Terms take effect.
Continued use of the Service after the effective date of the revised Terms constitutes acceptance of those changes.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Language and Precedence
These Terms are provided in English.
Translations into other languages are for convenience only.
In case of conflict or ambiguity, the English version shall prevail.
